RESULTS OF INVESTIGATION : When the tablets were shipped in interstate com- merce, they were packaged in bulk drums, and, upon their receipt by the con- signee, a number of the tablets were repackaged into bottles. NATURE OF CHARGE : Tablets in drums. Misbranding, Section 403 (j), the arti- cle purported to be and was represented as a food for special dietary uses by reason of its vitamin content, and its label failed to bear, as required by the regulations, a statement of the kind and quantities of vitamins supplied by the article when consumed in a specified quantity during a period of one day. The article was misbranded in this respect when introduced into and while in inter- state commerce. Tablets in bottles. Misbranding, Section 403 (j), the article purported to be and was represented as a food for special dietary uses by reason of its vitamin content, and its label failed to bear, as required by the regulations, a statement of the proportion of the minimum daily requirements of vitamin Bi and vitamin B2 and the amount of vitamin B6 supplied by the article when consumed in a specified quantity during a period of one day; and the label of the article failed also to bear the statement "The need for pantothenic acid in human nutrition has not been established." The article was misbranded in this respect while held for sale after shipment in interstate commerce. DISPOSITION : July 31, 1953. Vita Laboratories, Auburn, N. Y., claimant, hav- ing admitted the truth of the allegations of the libel, judgment of condemna- tion was entered and the court ordered that the product be released under bond for relabeling under the supervision of the Department of Health, Educa- tion, and Welfare. On March 9, 1954, the 18 drums of the product were destroyed by the U. S. marshal.
