ALLEGED SHIPMENT: The olives were shipped on or about January 11, 1954, by the A. C. L. Haase Co., from St. Louis, Mo., and the chocolate bars were shipped from Hershey, Pa., sometime during September 1953. PRODUCT: 5 cases, each containing 12 jars, of olives, and 16 boxes, each con- taining 12 4 ounee chocolate bars, at Iola, Kans. LABEL IN PART: (Jar) "Haase's Magic Circle Salad Olives Spanish Olives and Pimiento No. 24 Dr. Wt. 14 Oz." NATURE OF CHARGE: Olives. Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a filthy substance by reason of the presence of insect-infested and insect-damaged olives, and of a decomposed substance by reason of the presence of decomposed olives.
