ALLEGED SHIPMENT : On or about April 6, 1954, from the State of Ohio into the State of Indiana. LABEL IN PART: (Mug) "Capitol Brand Peanut Butter * * * Net Weight 12 Oz." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in part of a filthy substance by reason of the presence of insect fragments, saw- tooth beetle leg fragments, and tribolium- beetle mandibles; and, Section 402 (a) (4), the article had been prepared and packed under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION : November 10, 1954. The defendants having entered pleas of guilty, the court fined the company $500 and the individual $250.
