Mass., against Packers' Laboratory, Inc., Boston, Mass., and Robert A. Poling, president and treasurer. ALLEGED VIOLATIONS : Between 4-8-59 and 6-25-59, while quantities of mono- sodium glutamate were being held for sale after shipment in interstate commerce, the defendants caused quantities of sodium chloride (salt) to be added to the article and caused such article containing the added sodium chloride to be sold and delivered to firms in Massachusetts, which acts re- sulted in the article being adulterated and misbranded. In addition, the de- fendants caused quantities of the article to be shipped in interstate commerce from Boston, Mass., to New Britain, Conn., and Providence, R.L, on 6-8-59 and 6-26-59. LABEL IN PART: (Drum) "99%+ Monosodium Glutamate." CHARGE: 402(b) (2)—a substance consisting of a mixture of sodium chloride and monosodium glutamate had been substituted for monosodium glutamate; 402(b) (4)—sodium chloride had been added to and mixed and packed with the article so as to increase its bulk and weight and reduce its quality and strength; and 403(a)—the label statement "99%+ Monosodium Glutamate" was false and misleading since such statement represented and suggested that the article consisted of more than 99 percent monosodium glutamate, whereas it did not consist of more than 99 percent monosodium glutamate.
